DOWNLOAD LICENSE CONTRACT
This is a legal agreement between you the end user and New Vision Software, Incorporated ("NVSI"). BY DOWNLOADING AND INSTALLING THIS PRODUCT YOU ARE AGREEING TO BE BOUND TO THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL THIS PRODUCT AND REMOVE IT FROM YOUR COMPUTER.
GRANT OF LICENSE
NVSI grants you a non-exclusive license to use the enclosed NVSI software program (the "SOFTWARE") on one computer provided that you registered and downloaded this software demo from the NVSI website and are the only person using the SOFTWARE. You agree to not distribute this self installing demo. However, you may share a link to the NVSI website with others who can register and download their own version. If you are an entity, NVSI grants you the right to designate one individual within your organization to have the right to use the SOFTWARE in the manner provided above.
OTHER RESTRICTIONS
You may not rent, lease, lend, sell, sublicense or transfer the SOFTWARE. You may not reverse engineer, decompile or disassemble the SOFTWARE. You may not remove or alter any copyright notices from any components of the SOFTWARE. Violation of any restriction herein shall render this license void.
COPYRIGHT
The SOFTWARE is copyrighted 1994-2009 by NVSI with all rights reserved. None of the components of the SOFTWARE may be copied, removed or altered, in whole or part, for any unauthorized use. Portions copyrighted 1999-2009 Bentley Systems, Inc.
LIMITED WARRANTY
NVSI does not warrant that the functions contained in the SOFTWARE will meet your requirements or that the operation of the SOFTWARE be uninterrupted or error-free.
NVSI DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE. This limited warranty gives you specific legal rights. You may have others which vary from state to state.
In no event will NVSI, its licensees, distributors or dealers be liable for direct, incidental or consequential damages, including but not limited to damages resulting from loss of data or business opportunities, resulting from the SOFTWARE, either alone or in conjunction with other programs.
No NVSI distributor, dealer, agent, or employee is authorized to make any modification, extension, or addition to this limited warranty.
GENERAL
This Agreement constitutes the entire agreement between you and NVSI. It is governed by the laws of the State of Illinois.
RESTRICTED RIGHTS LEGEND
NVSI SOFTWARE and documentation thereto are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause in DFARS 252.227-7013. The contractor/manufacturer of NVSI SOFTWARE and documentation is New Vision Software, Incorporated, 130 Kainer Ave., Barrington, IL 60010, (847) 382-1532.
